55-year-old Jason Warren, who crashed his car into a wall and then failed to provide a specimen for analysis, has been banned from the roads for 22 months.
Warren, of Grange Road in East Cowes, appeared at the Isle of Wight Magistrates Court for sentencing last week (Friday 11th October) having previously admitted failing to provide a specimen for analysis.
Prosecutor Lauren McConnell told the court that on the afternoon of 31st March (Easter Sunday), Warren crashed a Nissan Leaf into a parked BMW and then a garden wall on Cambridge Road in East Cowes – as previously reported by Island Echo.
Police and Paramedics were called to the scene and it was here that a roadside breath test was conducted returning a reading of 100 – almost 3x the legal limit of 35.
Warren was arrested and taken to Newport Police Station where he failed to provide a specimen for analysis, despite attempting an evidential test 4 times.
Defending, Michael McGoldrick told the court that Warren suffered from various health conditions including PTSD, anxiety and high blood pressure and that these conditions could have affected his ability to give a sample.
A Newton Hearing took place at the Isle of Wight Magistrates on 1st August, during which a pre-sentence report was ordered.
In sentencing Warren, Magistrates handed the 55-year-old a 12-month community order with a 6-month alcohol treatment requirement and 15 rehabilitation days attached. He was banned from driving for a total of 22 months and ordered to pay a £120 fine, £85 costs and a £114 surcharge fee.
