The case of an Isle of Wight businessman who denies breaching a planning enforcement notice has been pushed back to next year.
Louis William Tudor Smith appeared at the Isle of Wight Crown Court this week to stand trial on 5 breaches of an Isle of Wight Council planning enforcement notice, issued in April 2019.
It is alleged between 31st October 2020 and 27th April 2021, Mr Smith failed to comply with the council’s enforcement notice for his land at Merrie Gardens, Lake, which would have seen waste removed and land regraded and re-seeded.
He pleaded not guilty to all the charges in June last year and a trial was due to start in July.
However, the case only made it to Crown Court this week when it was scheduled to be held over 4 days.
Due to court pressures and other factors, the trial has now been adjourned until 6th February 2023, to allow enough time for the trial to take place.

Crown Court Trial for planning breach – so no wonder criminals get away with crime if Judge’s time wasted like this – there so many worse things going on in the world
What a joke!!
No doubt will get off next year
Oh yes.Probably worships at the judges trouser-rolling temple.
That’s Baron Louis William Tudor Smith, if you don’t mind.
Planning rules only apply to untitled plebs, don’t you know.
they did not bother about the caravan park that had no planning permission so how come they make a palace for this case ? anything to do with nepotism ? only certain families can get away with crimes ?
Nothing changes except the faces…
I do wonder how some things on this island get permission so I hope they will look in to this case as a breach is a breach and people should not get away with it
