Enable Law, a specialist clinical negligence and personal injury law firm with a strong national reputation, but also significant local links, is helping to support injured people on the Isle of Wight. Darren O’Sullivan is a senior clinical negligence and personal injury solicitor at Enable Law. He has dedicated a large part of his career to supporting injured people on the Isle of Wight. After specialising in personal injury law in 2002, Darren worked on the mainland before deciding to return to his home on the Isle of Wight to build his practice and use his knowledge to support fellow Islanders In 2014, whilst working for Novum Law, Darren helped the firm open an office on the Island. As Head of office, Darren supported hundreds of local people at very difficult times of their lives when the actions or negligence of others resulted in them sustaining serious and, sadly many times, life-changing injuries. Within the last year, Darren decided to step down from his role as one of the Directors of Novum Law but was dedicated to continuing with his local Island practice. For that reason, he decided to join Enable Law as a Partner. As his primary motivation was to keep working for local people, Darren still spends the majority of his working week on the Island which means he can retain personal relationships with his clients and continue seeing them on a face-to-face basis to keep them updated on their cases. Likewise, it means that he can visit potential clients at home on the Island, or any other location of their choice, to help them share their story and concerns without the need to travel or incur additional expenses at a time where being close to family in a familiar setting can be very important to them. The objective of bringing a personal injury or clinical negligence claim on behalf of an injured person is to help them try to get back to where they would have been had their injury not happened. Often this means that it can take a long time for a case to conclude as a solicitor needs to gather a lot of evidence about what happened but also gather information about how it will affect the injured person in the long term. During this process, clients have to share a lot of information about the incident but also about their personal life, so it is really important to be represented by someone they feel confident they can trust and get to know well. Darren is approached on a weekly basis by people who have concerns about the medical care they receive or who have been injured in serious accidents on the road or at work. He is always happy to offer his time and expertise to help them understand what happened and to establish if their injuries were caused by the negligence of someone else.
Where the investigations show that there is likely to be an element of third-party blame, Darren will accept the case on a “No Win, No Fee” basis, so clients never have to worry about paying for his work upfront and he only gets paid if the case is successful. Darren is also often approached by people who have an ongoing claim but want a second opinion and are considering changing solicitors. That may be because the lawyer representing them has changed firms, or often because they want to be represented by someone local who they feel they can trust. Employees safety is imperative, so many employers take
short cuts.
Clinical negligence seems to, unfortunately, be coming more common, as the NHS evade responsibility of ‘care of duty’ – possibly due to nursing staff being overworked, but also due to the unrealistic targets that a variety of political parties have introduced.
