Despite the hardship it will put on him and his family a Ryde man has been banned from driving for 6 months after accumulating a total of 12 points on his licence.
33-year-old Samuel Martyn Williams, of Great Preston Road in Ryde, explained to Magistrates how losing his licence would have an adverse effect on his 2 children and could potentially put his employment at Vestas in jeopardy. Despite his representation, Magistrates took a firm stance and said it did not amount to exceptional hardship.
The court heard from prosecutor Liz Miller the brief details of the case. On 10th October last year, Williams was driving through Binstead and Wootton towards East Cowes when he was observed speeding by a Police Constable. As the Williams entered East Cowes he was pulled over and his details checked. It was soon discovered that he did not hold valid insurance for the Dacia Logan he was driving, which belonged to his father.
Although Williams had his own car with full insurance, it did not cover him to drive other motor vehicles. Furthermore, Williams’ brother had removed him from their father’s insurance as a named driver, without Samuel’s knowledge.
Defending, Henry Farley said that his client believed he was insured but had been inadvertently removed by his brother despite being on the policy for a long time.
In an application for exceptional hardship, Williams said that he will be unable to take his 12-year-old son to boxing in Newport and will have difficulty taking his 6-year-old daughter to horse riding and swimming, as well as taking each child to their respective mothers in Shanklin and East Cowes. He also said that he will struggle to get to work at Vestas near Cowes, with the bus leaving Newport Bus Station at 17:55 – with a start time at work of 18:00.
Magistrates ordered 6 points to be put on Samual Williams’ licence, which resulted in a driving disqualification of 6 months as he already had 6 points on his licence.
Looks like it’s time to buy a bicycle and the kids will have to put their hobbies on hold for 6 months.
Well done! Should be risking it then should he if his kids depend on him!
This man was not on Drugs nor Intoxicated !! he made a mistake thinking he was Insured surely
he should have been given some Leniency and only given 3 points ..He is employed with a family and all the commitments that come with that .Time and Time again we see on here Drunken Drugged up Scum in court for driving .assault and serious crimes and are given a slap on the wrist ..the Scales of Justice require a Rebalance !!
It’s been this way for years now. The worse scum someone is, the more they will get away with whatever it is they do. It’s like they think well those types can’t help it, but a more decent person should know better and so they think they’ll make them pay more to make an example of them, to show that ‘decent’ people can’t be allowed to get away with things that scummy types can get away with. It’s double standards and it should change, it should be the other way round.
Ban them all, they won’t make that ‘mistake’ again.
even if he thought he was insured to drive , it is the drivers responsibility to check, now if this chap had unfortunately, had an accident and you were the innocent party caught in it, would you say the same when you find he had no insurance, think not, I and a few of my neighbours have been the victims of 1, yes 1 uninsured driver and we have had to pick up the cost
He knew full well he wasn’t insured, pulled out the blackmail card and tried to pass the buck.. drink, drugs or not, this driver clearly wasn’t thinking about his children when he speeded, uninsured!! there is NO EXCUSE!
Well Said !! could not agree more with ” Islander born and Bred “
Made an error or not,but banning him, may loose his job end up on benefits etc why don’t the Court enforce and make him pay for Insurance and fine him. If he was drug driving, no licence etc get the same a ban. Court’s need to get better at punishing and imprisoning those that don’t care and scum of society . Many of us make mistakes over Insurance just like forgetting spots or birthday s
He was initially pulled over for speeding. Already had 6 points, so no angel.
If he’d mown your kid down whilst speeding and uninsured, you wouldn’t be so chummy about him.
