A Totland man has been handed a £583 fine after being found to have been driving without insurance when he appeared at the Isle of Wight Magistrates Court.
Paul Lee Nye, 35, of York Lane, was stopped by a police officer outside the small Co-Op store on Avenue Road, Freshwater on 7th December 2020. A vehicle check revealed that the Audi A3 was uninsured.
The court heard that Nye attempted to prove that the vehicle was insured by loading up his insurer’s mobile app – which also showed no policy was in place.
Magistrates were told that Nye usually pays his car insurance via direct debit and had received a renewal quote from his insurer, leading him to believe that his policy had been renewed and was in place, despite never receiving an official insurance certificate. Nye’s defence claimed that he had not noticed the lack of payments leaving his bank account and was at the time was completely of the belief he was insured to drive.
Nye made a request for special reasons to be considered during his hearing, which were denied by the Magistrates. He then further applied for ‘exceptional hardship’ considerations due to his need to assist his family member with trips to the hospital for medical treatment. He also expressed that he could lose his job as a supervisor for the teams currently carrying out WightFibre network upgrades on several of the Island’s roads.
Nye was handed a £583 fine and must also pay a £58 surcharge alongside £85 in costs. He has also had 6 points added to his license, but escaped a driving ban.
