The High Court has granted permission for a Judicial Review into the Isle of Wight Council’s decision to approve the Sunny Oaks Renewable Energy Park near Wootton, marking a significant development in a long-running planning process.
The case will examine whether the Isle of Wight Council followed the correct legal procedures when determining the planning application for the large-scale renewable energy scheme off Whiterails Road.
The Judicial Review is being brought against Isle of Wight Council and Sunny Oaks Renewable Energy Park Limited by Luke Davis, who owns land adjacent to the proposed solar farm site.
The proposed development is linked to John and Marjorie Glasgow, alongside Ridge Clean Energy Ltd.
The Sunny Oaks proposal has been the subject of extensive coverage and debate on the Isle of Wight since 2022, with revised plans, consultations and committee discussions taking place over several years.
Planning permission for the scheme was conditionally approved by councillors, although the process has not been without controversy, including a previous error by the Council which resulted in a related decision being quashed and an apology issued.
Speaking about the case, Mr Davis has said:
“This case is not about opposing renewable energy or preventing progress. It is about ensuring that decisions affecting our landscapes, our communities, and our ancient woodlands are made lawfully, transparently, and with proper regard to the evidence.
“I am grateful that the Court has recognised the importance of these matters.”
The hearing is scheduled to take place at the High Court in London on 6th May 2026.
The outcome of the Judicial Review could have significant implications for the future of the development and the decision-making process behind it.

Has nobody heard???? We ( as in the UK) need all the green renewables we can get. Bloody NIMBYS. Shame on you who disagree!
It sounds more like Mr Davis is watching our backs and making sure this hotchpotch of a so called council, that we pay for, know their job and do their job proberly. Do far they haven’t.
Another couple on the renewable gravy train. I hope karma gets them. Well done Mr Davis for continuing your court review. How can it be better for humanity having our green and pleasant land covered in metal and glass. We need ro be producing a lot more of our own food and not relying on expensive imports.
