A 40-year-old man from Wroxall, who is accused of failing to provide a specimen of breath following a crash, has pleaded not guilty to the charge against him.
Nigel Brayley, of Clarence Road in Wroxall, appeared before the Isle of Wight Magistrates Court on Friday charged with 1 count of failing to provide a specimen for analysis – vehicle driver.
Liz Miller, prosecuting, told the court that Brayley was involved in a single-vehicle collision in Newchurch on 16th July, in which his car was damaged.
He was taken to St Mary’s Hospital, where his injuries were assessed and he was deemed okay to be taken into custody at Newport Police Station. It was there that, when asked to provide a specimen of breath, it is alleged Brayley failed to provide without reasonable excuse to do so.
Brayley denies the charge, pleading not guilty in court.
He was granted unconditional bail to next appear at the same court on 4th October for a case management hearing, before a trial set for 15th November.
