A man who was arrested for allegedly being in charge of a motor vehicle whilst drunk, despite having the engine turned off, pleaded not guilty at the Isle of Wight Magistrates Court on Tuesday.
Jason Goulding, 53, of Wilton Road in Shanklin, denied being in charge of a motor vehicle whilst alcohol level above limit.
The prosecution said that Goulding was seen sitting in the driver’s seat of his Suzuki Swift on Hope Road, Shanklin shortly after 21:40 on 18th June, with his engine turned off.
Police came up to the car and saw him sitting there. They requested a roadside breath test which he failed, resulting in his arrest. He carried out an evidential breathalyser at the Police station and blew 106 – over 3x the legal limit.
The case has been adjourned for the trial on 8th September.

I’m laying in bed with a hangover, still way over limit, my car keys are in arms reach and my car is the other side of the bedroom window 8ft away from my bed. I’m in charge of that vehicle right now but I’m not driving it.
How are you in control of your vehicle if your in bed.
Your keys have to be in the ignition and you have to be inside the car. You are not in charge of the car otherwise.
Tested over the limit twice but went not guilty. Must have a cracking defense. I can’t wait to hear this one. Roll on September (if the solicitors aren’t on strike).
A few years ago, I was informed by a police officer, that if you are out drinking, and you have your car keys with you, and you get pulled.. Police could state that you intended to drive… !! Since then I always leave car and car keys at home if out for a beer…
Yes they could say that, but would a court agree.
