A serving prisoner who spat in the face of a guard who had just given him some food has been ordered to pay compensation of £50.
Mylo Rose, 31, of HMP Isle of Wight, pleaded guilty to assault by beating of an emergency worker when he appeared before Magistrates at the Isle of Wight Magistrates Court earlier this week (Tuesday).
Liz Miller, prosecuting, told the court that on the afternoon of 10th July 2022, at around 15:50, prison officers were moving Rose to another house unit after receiving reports he was intoxicated.
Handcuffs were applied and the 31-year-old was taken to house unit 11. Once placed in a cell there, officers noticed that Rose was in an emotional state, fluctuating between being upset and apologetic and being aggressive.
Rose then spat in the face of an officer before attempting to throw a punch at him. The officer was able to dodge the punch. Fellow prison officers then worked to detain Rose.
The officer involved sustained no injuries but admitted he felt degraded by the incident which was, as he deemed, ‘unnecessary’.
Defending, Michael McGoldrick said that his client had ‘lashed out’ and that Rose – who isn’t eligible for release until at least June 2024 – had been making good progress in the prison system.
Magistrates handed the 31-year-old a 4-week custodial sentence that will run concurrently with his existing sentence.
He was ordered to pay compensation of £50, costs of £85 and a victim surcharge fee of £154.





























































































Where does he get this money from ?
You the Tax payer, you pay him wages to work in the prison . the same as you pay every one of the unemployed, and what a great life they all have wilst your working your butt off.

How the hell was he intoxicated? Do they have a pub in prison now or just bars
No sentence or deterrent at all. 4-week custodial sentence that will run concurrently with his existing sentence. To prevent any assaults of any kind on Prison Officers / emergency workers should be 10 year’s minimum, that would wipe the smile off their faces. Good on the office to possibly get some justice in this day and age.
Concurrently…what a load of twaddle…why not consecutively? Makes a mockery of the punishment.
It does have an effect. When nearing the end of a sentence, ‘good behaviour’ is considered when assessing early release. Another conviction within your time in jail affects your record or counts against any progress made.
