A Newport man who refused to give a specimen for analysis when stopped by Police has appeared in court.
Dylan Tuckey, 23, of Hinton Road in Newport, pleaded guilty to failing to provide a specimen for analysis when he appeared at the Isle of Wight Magistrates Court on Tuesday (30th May).
Ann Smout, prosecuting, told the court that at around 18:30 on 15th May, Tuckey was seen driving a Ford Transit van along Fairlee Road in Newport when – following a check – it showed that the vehicle was being driven without a valid MOT.
Having followed Tuckey and the van for a short while officers – having activated their blue lights – stopped him at the car park on Lugley Street.
When asked by the Police as to why there was no MOT on the van, Tuckey contacted his boss who said that there was indeed a valid MOT and that his employee should refuse to comply with any requests for a specimen. Something Tuckey did.
Having refused at the roadside, the 23-year-old was taken to Newport Police Station where he refused to give a specimen once more.
The court heard did hear however that Officers had stated they had smelt alcohol on Tuckey’s breath when they apprehended him.
Defending, Jim Osborne, said that Tuckey hadn’t drunk anything and that if he had completed a specimen then it would’ve returned a negative result. He also added that the 23-year-old was expecting to lose his job as a result.
Magistrates adjourned the case until 30th June to allow a pre-sentence report to be compiled. Tuckey was handed an interim driving ban in the meantime.
