32-year-old Thomas Kirby, who sustained serious injuries after crashing his motorcycle in Apse Heath back in September, has been convicted of failing to provide.
As previously reported by Island Echo, Police were called to Newport Road at 21:59 on 15th September following reports of a single-vehicle collision.
The Hampshire & Isle of Wight Air Ambulance was scrambled to the scene, but Kirby was later taken to St Mary’s Hospital by land ambulance having suffered non life-threatening injuries to his head and ribs.
It soon emerged that the rider – now known to be Kirby of Slade Road in Ryde – failed to provide a specimen for analysis, having been suspected of driving whilst impaired through drink or drugs.
Appearing at the Isle of Wight Magistrates Court on Friday, the local care worker pleaded guilty to the offence.
Leah Dillion, prosecuting, told the court that a test could not be conducted at the roadside due to Kirby’s injuries, but when he was asked to complete a blood test at the hospital he said no.
Defending, Barry Arnett said that his client was in a state of panic and did not deliberately intend to be awkward.
Magistrates handed Thomas Kirby a 14-month driving ban and fined him £276. He was ordered to pay £85 costs with a £110 surcharge.


























































































These so called DEFENDERS should be held to pay the costs.. and some should be fined… as they make up any plausible excuse as to why the person(s) are actually in court.. which leads to lesser fines, sadly…
I’m not sure that you understand how the process works. Every person who appears in court is entitled to a legal representative to put their case before the court and every defence lawyer is legally obliged to offer the best defence they can for their client. Yes, mental health is used a lot but they can only work with what they have, in most of these cases there IS no defence. It’s not the lawyers fault is it?
No sympathy from me.
