A 36-year-old motorcyclist has been banned from the roads for drug driving, but he was only caught by the Police after a car drove into him.
Daniel James, of Hunnyhill in Newport, pleaded guilty to a single charge of drug driving (THC) when he appeared before Magistrates on Tuesday 29th July.
The court heard details of how, on 8th April this year, James was riding down Staplers Road in Newport when he was involved in a collision with a car. As he was overtaking traffic, the vehicle turned into his path.
The motorcyclist was taken to hospital for his injuries, and subsequently received a £4,500 insurance payout as the collision was deemed to be the car driver’s fault.
As is standard practice in a collision, Police conducted a drugs wipe on James, who was later found to have 3mg of THC (cannabis) in his system – 2mg being the legal limit.
Magistrates, taking into account James’ £850 per month Universal Credit and £4,500 compensation, ordered the 36-year-old to pay a £120 fine, £85 costs and a £48 surcharge.
He was banned from driving for 14 months.

The insurance company may now reconsider the compensation claim, stating that the insured may have been unfit to drive due to the misuse of drugs.
There have been many payouts where the Motor Insurers’ Bureau (MIB) has deemed the policy null and void. While the MIB is often the place which settles claims when there is no insurance, they may still reconsider the payout and retrieve it.
This one is for the potheads who try and think this drug should be legalised like it’s candy. It never should have been a legal amount and the medicinal usage is a massive stretch. Was it really the cars fault? I somehow doubt it and should be appealled.

So he can afford to run a motorbike and buy drugs on his Universal Credit but the bench only fine him £120 when he had just trousered £4,500. Of course crime pays. If lay benches cannot make sensible adjudications then it is hightime they were aboloshed in favour of all Magistrates Courts having District Judges.
