The Isle of Wight Council’s enforcement action against the owners of a holiday home that was being used as a permanent home, located on the outskirts of Chale Green and Niton, has been upheld by The Planning Inspectorate.
Appletree Barn off Appleford Lane was granted planning permission to become a holiday home back in 2016, having previously been used as a stable block. However, the owners began living permanently in the property in 2018, in breach of planning conditions that require the use to be limited to holiday occupancy only.
The council had served an Enforcement Notice that required Mr and Mrs David Heath to stop living there. In response, the couple chose to appeal the notice, arguing the holiday accommodation was not viable and that it should be used as a dwelling.
Mr and Mrs Heath told the Council that they had no other place to live until they sold the dwelling. They previously owned Little Dolcopice Farm.
However, The Planning Inspectorate’s Nick Fagan agreed with the Council’s concerns about the unjustified loss of the holiday unit, which is located within the Area of Outstanding Natural Beauty (AONB). Following a site visit on 9th March, the inspector found the location was not suitable for a permanent home, due to lack of access to services and facilities and the loss of a high-quality holiday home.
As a result, the owners will be required to leave by November this year.
Councillor Paul Fuller, Cabinet member for planning, has this week said:
“Planning conditions and their compliance within our Island is so important.
“To protect the Island’s demand for high-quality holiday accommodation, and the need for housing to be located in sustainable locations is paramount for our Island’s economy.”

I had to pay it back dated when i lived in a Caravan even though it was deemed to be a Holiday Home and i was told i could live there permanently when i bought it?
Surely the Council Tax department had to Band the properly?????
They should of kept it as a stable block and made it twice the size. These types of things are accepted by planners apparently.

Actually not coffins dodgers but locals who have owned the land and stables for 34 years, and are still both working in the local area. I was born 300m up the road. We are victims of townie incomers who do not want locals in the area .We have tried to sort this out through the councils planning process but have found that they the council do not follow their own planning & enforcement policies & procedures . It appears that the council think that only tourists should be allowed to enjoy our countryside. It’s about time they supported local rural working people .
The council state it’s unsustainable for one family to live here for 52 weeks a year, but perfectly sustainable for 52 families to live here for a week.

Planning permission to build a holiday home is not planning permission to build a permanent residence. There are different rules for good reasons. These people are just trying to make money by circumventing the system. They sold their own home to make a pile of money and then moved into the holiday home, before trying to get its status changed into a permanent residence. Just trying to work the system to make money. I have no sympathy for these cheeky chancers. If you let this sort of thing go, everyone caravan and holiday home on the island will be full of benefits scroungers from the mainland all year round. Do you really want that?
Rule 1: Planning permission is
decided by “what is best for the land”.
Step 1: ask the planning department what type of permission they would consider best for the property you would like planning permission for.
Action 1:
Look to see what type of restrictions have been applied to other people who were granted that exact type of planning permission.
Decision 1: is that type of planning permissions something you can live with and other conditions rules that you can keep to?
If you decide yes to decision 1: keep to it!
No point in crying about it and coming up with conspiracy theories when it is that simple

The council doesn’t bail people out anymore, they have nowhere to put them other than temporary accommodation which is guess what a caravan, hotel or some other holiday accommodation, so the council pay a huge rent to the likes of awaze. It might also surprise you to know that for every property up for rent there are 50 applications as supply is so limited, you are obviously clueless what some families are going through, people don’t intentionally make themselves homeless

I was renting a room in a multiple occupancy and the council decided it should be returned to a family home, so I had to get out, so I went to the council and said as they’ve made me homeless they’ll have to rehouse me, they said that I had made myself homeless by being there and wouldn’t help me
They are not homeless, if you read the report they can stay there until November.
So kick them out just before Christmas when it’s cold & wet. Splendid!
So when they can’t stay there they can decorate and do maintenance 24/7 wich is all above board
The IWC successfully makes 2 people homelessness. Great result. Now they can give them a council house.

So how does that narrative work in regards to the loss of a long established Holiday Let on Lee Farm in Wellow? Just to recap – get rid of tourist asset; allow market value housing to be built in an unsustainable location; enable affordable housing quota to be waived; then enter into a clandestine undertaking to construct an isolated length of cycle track which now has no funding! You couldn’t make it up.
Watch out ,Gurnard Pines and Sandown Bay Holiday Apartments next on the council’s list as they are all holiday lettings.

What NONE of you have considered is the reason why we have a housing crisis is because of millions of extra bodies arriving into the UK recently.
NONE come with land or a home, and almost all have no money to buy or even rent one.
So they take mostly mainland homes, thus far, and then mainland people MOVE here to escape the areas that ‘they’ no longer feel comfortable living in.
Thus such indirectly effects all of us here

There are more empty unused buildings than there are people who don’t have somewhere to live. The issue is people hoarding houses as investments, 2nd & 3rd homes & running air bnbs that are empty half the time. You could stop all immigrants & refugees from entering the country (Be a bit stupid as the NHS & various other sectors are propped up by foreign nationals but hey ho) & there would still be a housing crisis just as long as property is seen as an asset rather than a home. Focus your energy on the prices of homes rather than folk looking for a better life in one.

Have they candles and whole in ground for toilet?. If we own our land/ property we should be allowed to live on as we like,this couple caused no harm to anyone and how does living in for 10mths any different to 12mths. Council did same to caravan park in Sandown and refused to allow 12mths- outcome it closed,hundreds homeless and council had to fund and find temp acc. Think officers were directed by Councilor to say no. Council trying to stop holiday homes- then say want more!.
Ha ha – as though Isle of Wight Council are concerned about tourism!!! Overgrown Rights of Way, rundown towns, poorly maintained steps down to some beaches, scruffy potholed roads, privately run ferries charging massive prices, weeds everywhere you look, residents paying ever more for ever less, and to top it all, their own County Hall building is an absolute eyesore with filthy windows. Couldn’t run a bath, in my opinion.

Not what I see here, a family who will be force out of there home at the cusps on the of winter so they can sell an over price caravan to people who have to pay for the most expensive water crossing in the world. Double standards yet again, the council are allowing a chap to live in a shed with no running water or toilet facilities on the Esplanade in Ryde. He has junk spilling out on to the pavement it looks a right eyesore & must breach every health & safety standard in the book, yet turn people out of a perfect home. Unbelievable.
Perhaps the couple should have been clever and rented the converted barn to themselves as a holiday let through a company they set up?

I am astoiunded that so many people are so unkind when they do not have access to a complete story. Technology now allows people to form opinions and be judge and jury without any understanding of the full evidence. I read the last comment by ‘Lilly’ and hope that she never has to sit on a jury. Clearly both sides of a story have to be heard IN FULL before comments can be made that imply they understand the complete story. As I do understand the complete story, I can categorically state that so many are wrong or motivated be unkindness or bigotry. What a sad society we live in, when people are motivated to write such negative comments about a couple who show kindness and concern to others.

The Heath’s (Information available publicly) protested against the Councils own decision. They lost. They have tossed the dice and, frankly, they lost because they broke the rules.
They are not without funds. They are not without property although Mrs Heath does not state that on the housing crisis Facebook page. Instead she claims under her name Teresa Allen, that all are against her.
They applied permission for a holiday home. They then lied about living there. Truly the result is just. They just don’t like it.
What about all the so called holiday caravan parks such as Lower Hyde which have quite a few caravans permanantly lived in all year by their owners, a blind eye seems to be tuned on these.
Well tell the council if that is the case.
