A Ryde man who breached a suspended sentence order after being found in possession of cannabis, has been spared jail.
Elliot Dwyer, 24, of St John’s Hill in Ryde, admitted possession of a controlled drug of class-B (cannabis) when he appeared at the Isle of Wight Magistrates Court earlier today (Tuesday).
Prosecuting, Lauren McConnell, told the court that on the 12th June, Dwyer was arrested on unrelated matters and taken into custody at Newport Police Station where he was searched.
During the search, Police found a quantity of cannabis in Dwyer’s possession.
Police were initially minded to deal with the offence by way of an out of court disposal that required Dwyer to pay a fee and complete a specialist course, but despite the fear of being taken to court if he didn’t comply, Dwyer didn’t complete the course in the allocated time.
It was back in February, that Dwyer was handed the SSO in question. On that occasion, he was handed a 26-week prison sentence, suspended for 18 months.
Defending Dwyer, Oscar Vincent, told the court that Dwyer knows he should’ve taken the out of court disposal and completed the course, adding that since the incident in June, Dwyer had refrained from using cannabis.
After brief deliberations, Magistrates opted not to activate the 24-year-olds suspended sentence order and instead fined him £120 and ordered he pay costs of £85. The breach of his order was marked by way of a £120 penalty.
