A Lake man who shut the door on a takeaway delivery driver without paying for the food he had ordered has been called an ‘idiot’ by the Magistrate who sentenced him.
Patrick O’Flynn, 41, of Lea Road in Lake, appeared before the Isle of Wight Magistrates Court earlier today (Tuesday) where he admitted a single charge of making off without payment.
The court heard how on the 30th January 2026, O’Flynn ordered a Chinese from a local takeaway. The goods were delivered to his address but after accepting the food, O’Flynn shut the door on the delivery driver and refused to answer.
Payment for the takeaway, valued at £33.30 was never received.
Defending himself, O’Flynn said that the decision was ‘stupid’ and that he was drunk and can’t really remember what happened on that day. He added that he knows he needed to pay for the takeaway and that he could do so in 3 weeks time.
The court heard that by committing the offence, O’Flynn was in breach of a suspended sentence order imposed back in July 2025.
When handing down the sentence, the head Magistrate told O’Flynn ‘I’m not being rude but you are an idiot. Why did you think this was okay?’.
Magistrates added that although O’Flynn was in breach of a suspended sentence, they weren’t going to ‘waste the Judge’s time’ in sending the case up to Crown Court.
O’Flynn was ordered to pay compensation of £33.30 and costs of £85.

It’s a suspended sentence, he has breached it, just activate it, please don’t tell me that every suspended sentence requires the crown court to waste its time in addition to time spent already by the magistrates court.
