An East Cowes man who failed to identify the driver of a van, which was involved in an incident with a bin lorry in Niton, has been handed 6 points on his licence.
It was on 8th April this year that a Ford Transit mounted the pavement at the junction of Lacey’s Lane and Newport Road, putting workers at risk.
Appearing at the Isle of Wight Magistrates Court last Tuesday (25th June), Peter Barrett pleaded guilty to failing to identify who was at the wheel at the time. Barrett, of Gort Road, also faced a charge of driving without due care and attention but this was dismissed at last week’s hearing.

Liz Miller, for the Crown Prosecution Service, explained that the matter had been reported to the Police, who requested information on the driver’s identity through a Section 172 notice. Barrett initially responded saying he did not recall the incident and needed to see proof. Video evidence was shown to the defendant, with no further communication entered into. Island Echo has attempted to acquire the video footage but the Isle of Wight Council says it has been unable to locate a record of the incident, stating it may be possible that the bin lorry involved is connected to an alternative waste management service. Defending, Tom Cooke said his client drives every day for work and that this conviction may make it difficult for him to keep his job due to insurance requirements. Magistrates fined the father-of-3 a total of £233 and handed him 6 penalty points on his licnce. He was also ordered to pay £85 costs with a £93 surcharge.

No, he was the driver. He tried to be clever to avoid prosecution but it didn’t work. The video evidence identified the vehicle but obviously didn’t give a clear enough look at the driver, so the police wrote to the owner requesting the driver’s details. He has been prosecuted for refusing to provide those details, so got away with the driving without due care and attention charge, although the points put on his licence is the same as he would have received for that offence.
Numb nuts… If he had put his hands up, he would have only got 3 points and a slap on the wrists. Courts don’t like liars at the best of times.And when you try to get someone else to take your points and get caught out, you’re looking at prison time for peverting the course of justice – as a few have found out . Tough sh**
some people think that they are clever but they are actually putting other people at risk by mounting the pathway which people walk on and the law is stick to the road or u get points on ur licence or even worse licence taken away so in a way he kinda deserved to get points but at the same time he is a father of 3
I really don’t see the relevance to him being a father of three. Are you saying that that should have been a consideration when applying the penalty? Surely, as a father of three, that only made his actions even worse!
Yep he should,he would soon kick off if another driver did same and killed one of his kid’s. Why didn’t he name the alleged other driver?, wasn’t insured?, got no licence or already points?. 95% of driver’s have never had points on licence, I’ve been driving all sorts here and mainland for 42yrs and touch wood have none.

Similar offences on the mainland attract a fine around £1,000. Did the police not check his policy he might of been the only named driver, also hope his insurance company hike up policy
Well most insurance companies allow driving any other car with the owners permission (third party) so they couldn’t prove it for certain. He just refused to identify himself.
Not on van (or commercial vehicle) policies they don’t.

A better punishment would be to refuse to empty his bins for the next 5 years, let him be booked in to dispose of his rubbish at Lin Tip each week. If he doesn’t show up then slap him in gaol.
