53-year-old Marcus Webb, who took a whizz in his car’s passenger footwell whilst struggling to stand upright, has been handed a suspended prison sentence and been banned from the roads for 3 years. Marcus Webb, of Carlton Road in Ryde, appeared before the Isle of Wight Magistrates Court on Friday (1st March) for sentencing, having previously admitted failing to provide. Munayah Hassan, prosecuting, told the bench that a Police officer caught sight of a vehicle in the vicinity of Sutton Close on Boxing Day last year. The vehicle was seen to be driven in a ‘chaotic’ manner and nearly crashed into a wall. PC Martin soon followed the vehicle into a cul-de-sac car park where he found Webb urinating in the passenger footwell with the engine of the car still running and the lights on. The court heard that Webb was ‘clearly drunk’ as he was slurring his words, smelt of alcohol and struggled to stand up straight. At Newport Police Station it is said Webb refused to provide a specimen of breath for analysis, resulting in a charge of failing to provide. Defending, Oscar Vincent said that Marcus Webb had been out playing pool with his family that evening but when he returned home he ‘needed space’. Webb went and sat in his car with some alcoholic drinks and, when he got cold, started the vehicle. Mr Vincent told the court that Webb cannot remember what happened after that point. A pre-sentence report compiled by the Probation Service detailed how Webb had taken steps since the incident to tackle his ongoing drink issues and that he had been actively engaging with the services offered by the Inclusion Rehabilitation Centre in Carisbrooke.
Taking into account the evidence before them and the mitigation heard, after lengthy deliberations, Magistrates handed Marcus Webb an 8-week prison sentence, suspended for 12 months. Webb must also complete a 6-month alcohol treatment requirement and 15 rehabilitation activity days. The 53-year-old was banned from driving for 3 years and ordered to pay costs of £85 and £154 surcharge fee. When being warned how his suspended sentence works, Webb replied saying:
“I promise, I won’t breach the order. I’ve learnt my lesson”.



























































































Since when have suspended prison sentance been given for drink driving?. Not that I’m against it, bring it on . Usually just given a ban and fine unless accident and injury.
8 week. No fine. Means absolutely nothing except he cannot pay it.
He was not done for “Drink Driving!”, he was done for “Failing to provide specimen for analysis”, this carries a harsher sentence, to stop people trying it on. The range is Unlimited fine and/ or 6 months in prison.
A motorist would only fail to provide if they know they had been drinking.
