62-year-old Kevin Miller, who was found driving whilst almost 5 times the drink drive limit – which is considered to be 1 of the highest readings seen on the Island – has avoided an immediate prison sentence.
Miller, of Blackhouse Quay in Newport, appeared before the Isle of Wight Magistrates’ Court today (Tuesday) after previously pleading guilty to drink driving.
The court heard that on the afternoon of 13th May this year, Miller was seen driving a Vauxhall Tigra which pulled onto Riverway in Newport. The vehicle did not travel any faster than 9mph and was swerving all over the road.
When Police pulled the car over, Miller was described as slurring his words and not being able to stand up straight.
He was arrested and taken to Newport Police Station where he gave an eyewatering evidential reading of 170mg of alcohol in 100ml of breath – nearly 5 times the limit of 35mg.
Miller was given an 18 week prison sentence, suspended for 12 months, as well as being ordered to complete a 90 day alcohol abstinence requirement, 7 rehabilitation days and 240 hours of unpaid work.
He was also disqualified from driving for 36 months and made subject to a re-test.
Miller was further ordered to pay costs of £85 and a £154 surcharge.

Drunk drivers account for 15% of road deaths. 6000-7000 people each year are killed or injured in drink drive incidents. Please don’t make light of a very serious issue that has had a potentially traumatising impact on people’s lives.
Fine, some people get hurt, but that’s the rules of our society. Cyclists are worse!
In what way are cyclists worse than drunk drivers? 961 cyclists were killed as a results of an accident with a motor vehicle in 2021. Of all accidents involving a bike, the cyclist is found to have contributed to the incident in only 52% of them. So please enlighten us as to how cyclists are worse than drunk drivers…

I mean my assumption would be that he uses his glasses for things like reading, but in the picture he is walking along the pavement, so doesn’t need his glasses on. I could be wrong, but also don’t see why it matters…

That’s it then, basically on the IOW you can get as pissed as you like and drive and as long as you don’t harm anything or anyone you won’t go to prison even if you are 5x over the limit…. I’d advise this offender to get a liver function test urgently.

Well if that doesn’t deserve a custodial sentence I will never know what an earth does ???? Can anyone enlighten me.
The reason for the lack in imprisonment in this case is a mixture of short sightedness and unintended consequences by the current Government.
The short sightedness is lack of prison places. The population has risen, however the prison places has not, if anything it has gone down.
The unintended consequences is that for a period ending on the first of April, the Magistrates court could sentence up to one year, but that has stopped. As the Magistrates court runs a lot faster than the Crown court, there was a blip of more people going to prison over a shorter period of time, filling up any available space.
So there is “no room at the inn”.
Take his car and crush it.
It will be 3 years before he can apply for a learners licence. He has to take an extended test…

No prisons as the Tories closed them all so they can give the money to their mates.
Prisions full of people who should have been secioned long before they committed thier crimes and treated..but the Tories closed all the mental health hospitals and brought in care in the community instead
