A man recently jailed for 2 years for threatening a woman with an axe has appeared in court again, this time for playing music so loud that Environmental Health had to step in.
Tomas Bateman, 32, now of Her Majesty’s Prison Isle of Wight, appeared via video link at the Isle of Wight Magistrates Court on Tuesday charged with 4 offences of failing to comply with an abatement notice issued by the Isle of Wight Council.
On behalf of the local authority, Miss Conway explained to the court that Environmental Health had received complaints from residents at The Square, Freshwater of loud recorded music coming from a neighbouring property. Investigations were carried out in January of this year and noise monitoring equipment was later installed, eventually leading to an abatement notice being issued against Tomas Bateman.
It had been determined that a ‘profound’ disturbance was being caused to an elderly couple and others by noise nuisance.
The abatement notice came into force at 10:00 on 29th March, but by the end of the day Bateman had already breached it – going on to breach the notice a further 3 times on 31st March, 1st April and 11th April, all witnessed by the Council’s Environmental Health officer investigating the matter.
On 15th April a warrant was issued to seize the music equipment from the property. However, the court heard that claims have since been made that the equipment belongs to Bateman’s father.
Defending, Oscar Vincent said his client suffers from mental health issues and substance misuse and at the time of the offences was suffering low, untreated mental health episodes, as well as drinking and consuming substances.
Bateman has previously appeared in court for waving a sex toy at an elderly woman, sending offensive texts, causing criminal damage and production of a Class B drug – cannabis, among other matters.
Magistrates handed Tomas Bateman a 15-month conditional discharge to run concurrently. He was also ordered to pay a £22 surcharge. The seized music equipment is to be returned.
You really wouldn’t want to live near to this waste of space, never mind right next door. I feel so sorry for all those residents who had to endure all the wrongs this idiot put them through. Needs to be kept away from society, nothing but trouble this bloke.
All that Time and council tax money wasted when Courts do nothing, given string of offences he should stay locked up,or at least live in isolation away from others he can halm.
people like him, who are too stupid to show consideration to their neighbours, once it has been pointed out, deserve to be evicted from their homes and slung on the street. If they own the house, it should be forcibly sold and the proceeds distributed between the aggrieved neighbours/mortgage holder.
It is high time that deadbeats and scumbags like this had access to state benefits cut to zero, access to housing cut to zero and then left in the street to freeze until they show some consideration to others.
