An Apse Heath man who sent a woman an explicit image of a penis, in what a judge described as a ‘disgusting offence’, has been handed a 12-month community order.
Martin O’Rourke, of Woods Drive in Apse Heath, appeared before a District Judge at the Isle of Wight Magistrates Court earlier today (Tuesday), having previously admitted sending a photograph or film of genitals to cause alarm, distress or humiliation.
The court heard how on 26th March this year, O’Rourke sent a picture of a penis to a woman after adding her on a social media site.
Lauren McConnell, prosecuting, said that although the pair knew of each other, there was no recent connection and that the pair had been introduced to one another in the 1990s.
Defending O’Rourke, Oscar Vincent told the court that the offence was of lower culpability and lesser harm. He added that the image was not of his client’s penis and was simply obtained on the internet.
Sentencing the 36-year-old, who has 9 offences on his record, District Judge Callaway handed him a 12-month community order with 12 rehabilitation days and 100 hours of unpaid work attached. He was also ordered to pay £85 and a £114 surcharge fee.
