22-year-old Bailey Smith has been jailed for 14 months after kicking a woman in between the legs and breaching an indefinite restraining order – all whilst on a suspended prison sentence.
It was on 23rd August this year that Smith, of no fixed abode, arrived at an address in Ventnor in an aggressive manner. It’s here that he slammed a door into the face of his victim before kicking her in the crotch area.
Smith appeared at the Isle of Wight Magistrates Court on 30th August and pleaded guilty to 2 charges of assault by beating and breach of a restraining order.
The court heard that at the time of the offence Smith was subject to an indefinite restraining order and was on a 6-month suspended prison sentence for an offence of GBH. That sentence was passed after Smith carried out a vicious, prolonged attack on a man in Ventnor, kicking him in the head multiple times.
During August’s initial hearing, magistrates also heard that Smith was drunk when he arrived at the victim’s house and that drink played a major part in his offending. The matter was sent up to the Crown Court with Smith remanded in custody.
It’s not the first time that Smith has committed an offence whilst on the suspended sentence. In June, Smith appeared before the Crown Court once again after smashing a glass pane at his mother’s house. However, Judge Neil Garnham did not activate his suspended sentence, instead adding 5 extra rehabilitation days and fining him £50.
Defending, his solicitors have told the courts that Smith suffers from ADHD and Aspergers and has a problem with drink, especially after coming to terms with a recent bereavement.
Appearing before the Crown Court for the 3rd time this year on Tuesday, Judge Richard Shepherd activated Bailey Smith’s suspended sentence, putting him behind bars for 14 months. However, he will serve just 7 months in prison minus time served on remand.
Put this hard man in the town square and we’ll all have a go at kicking him in the nuts. I would say balls but doesn’t have any. The judge should have given him 10 years none of the half sentence rubbish. The victim of this latest attack should sue the magistrate who failed to activate his suspended sentence, thereby leaving him free to attack her.

Disturbed is exactly right. If the picture was taken from further away, everyone would see who puny he is. About 7 stone wet! We saw him around the town a few months back, clearly under the influence of something, screaming at people & threatening them. One swift blow would put him down, but I guess others have more to loose than this scum will ever have. Clearly has one friend in Mr Garnham! Kicking off at his mothers house, breaking a pain of glass & most probably scaring her to bits, whilst being on a suspended sentence. Was in the eyes of Mr Garnham only worth extracting £50 this weirdo’s giro. Have him come around your house, smashing things Mr Garnham. See how you’d like it. About time Judges lived in the real world.

Aah gone into prison for the cold months of the year, out just in time for the warm weather. Disgusting – human life is obviously worth very little in todays courts. What about the poor woman the pain and the trauma, more than he has had.

People do genuinely have ADHD and they struggle as adults to fit in with society they get support through school if they are lucky and then are forgotten about when they become adults they dont process things in a way ordernary people can life is a walking time bomb for them .I dont justify what hed did but beleave me some women get a thrille from upseting them and pushing buttons that they know will escalate through frustration .
We dont now the whole story i bet somewhere in the middle you will find the truth .
