PC James Martin, a dog handler with Hampshire & Isle of Wight Constabulary, has denied an offence of misconduct in a public office and will stand trial next year.
It is alleged that PC Martin failed to take immediate action to release a man from custody following their wrongful arrest, once he discovered the arrest was unlawful.
The incident is alleged to have occurred in December 2022.
The case has been sent to trial by Judge Dugdale with a date set of October 2025.
PC Martin has been granted unconditional bail.
