A 69-year-old man who was waving a knife around at people he wrongly thought had told him to turn his music down has been sentenced to 6 months in prison.
Andrew Moss, of Colwell Chine Road, in Freshwater, pleaded guilty to 1 count of possession of a bladed article (knife) when he appeared in front of Magistrates at the Isle of Wight Magistrates Court today (Tuesday).
Prosecuting, Ann Smout told the court that on the evening of 29th August, at around 21:45, Moss came out of the door to his flat after hearing a car arrive in the car park below his building. In the car park, a fellow resident – and her son – were chatting in their car before being approached by Moss – who they believed had a knife in his pocket.
When asking Moss if he was okay, he replied to the pair whilst wielding and pointing at what the resident described to Police as a chef’s knife. They then proceeded to tell Moss that they were residents of the premises, which saw him back off across the car park before throwing around some cones that had been placed there.
Before heading back into his home, Moss turned around and pointed the knife at the car shouting ‘You’re f***ing lucky’.
Defending Moss, Amy Hosell told the court that her client was listening to music in his property and was told to turn it down by someone who he thought was his rival. He headed outside with the knife to deter and not threaten the individual only for it not to be who he thought it was.
She also added that Moss has had issues in regard to his health concerning his diabetes diagnosis in 2020 and that he admitted to being depressed and often feeling lonely and isolated. He had also had 4 cans of lager and 1/4 of a bottle of rum on the night of the incident, clouding his judgement.
Moss has 1 previous conviction for a similar offence back in 2015 meaning that he was eligible for a minimum of 6 months in custody – something Ms Hosell said he was terrified of.
Magistrates handed Andrew Moss a 6-month prison sentence – to which he replied ‘f***ing hell’ before being taken down to the cells.

So how is it he got 6 months but the lady who stabbed in the leg a few times get nothing. A is told they have 3 month to show a change in their behaviour. I honestly give up with justice system. It’s a joke

How is this justice when you see that other more serious crimes get let off!!

Pensioner gets a 6 month stretch in the slammer for waving a knife around, naughty and unacceptable but he didn’t use it, thank goodness. Some skanky cow in Shanklin stabs a woman with a chisel multiple times in the head and gets let off! What the f**k has gone wrong with these judges. They are not fit to be in the job.
6 months not long enough to dry out. Probably will get extension due to the DTs and his anger attitude.
