A man on the sex offenders register who failed to alert the Police of his new bank card has avoided having his suspended sentence activated after he appeared at the Isle of Wight Magistrates Court.
Billy Chilcott, 28, of Green Street in Ryde, pleaded guilty to failing to comply with notification requirements of the sexual offences act when he appeared in front of Magistrates on Tuesday morning.
Ann Smout, prosecuting, told the court that on 7th March 2019, Chilcott was convicted of sexual assault and placed on the sex offenders register for 7 years.
As is required for persons on this register, upon obtaining a new bank card Police must be informed within 3 days of the application. Something Chilcott didn’t do.
Whilst at Newport Police Station on 29th June this year conducting checks into the 28-year-old conditions and requirements, Police found that his new bank card had a different 4-digit ending – putting him in breach of his notification requirements.
Defending Chilcott, Oscar Vincent said that his client had lost his bank card and told his bank to cancel it and send him a replacement, not knowing that any of the digits on the card would change.
Magistrates opted not to activate Chilcott’s suspended sentence, instead adding 5 more rehabilitation days to his current community order, fining him £50 and ordering he pay a £34 surcharge fee.

Suspended sentence should have been activated! No excuses
Prisons filled with worlds dregs so little chance of jail terms for anyone unless committing worse crimes than those filling our prisons now.
Like the hospitals too many to attend to now we have an unofficial open door policy.
Time adds to the problem so will get progressively worse
