A convicted sex offender who failed to register an electronic device with Police is to learn his fate at the Isle of Wight Crown Court next month. Brian Gandy, 74, of Folly Lane in Whippingham, admitted breaching a sexual prevention order when he appeared at the Isle of Wight Magistrates Court yesterday (Friday). Lauren Stone, prosecuting, told the court that in October 2021 a judge at Shrewsbury Crown Court handed the pensioner a 12-month prison sentence, suspended for 2 years, for making indecent images of children and 2x possession offences. On 1st February 2023, officers visited Gandy’s home address and conducted a search of his electrical devices. Using specialist software, they were able to ascertain that there were other devices present that hadn’t been registered with Police. Gandy was arrested and his property inspected. During the search, Police found a Nexus tablet, which Gandy admitted was his. The 74-year-old said that it was indeed his device and that he had never registered it. Defending Gandy, Oscar Vincent told the court that the device in question was old and didn’t work and that it got lost in the move, when Gandy and his wife relocated to the Island a few years ago. Gandy was last in court back in March 2023 when he was fined £1,000 for failing to comply with notification requirements. This latest offence was committed during Gandy’s suspended sentence period and, as a result, Magistrates sent the case up to the Isle of Wight Crown Court. Gandy will learn his fate before a judge on 31st May. A pre-sentence report is to be compiled for that hearing.
