A man who drove a vehicle with 3 children inside whilst almost twice the drink-drive limit has been banned from driving for 18 months.
Tyler Cairns, 25, and formerly of Chestnut Close, Ventnor but now of The Foyer, Ryde, pleaded guilty to 3 offences when he appeared at the Isle of Wight Magistrates Court on Friday. He admitted driving whilst under the influence of alcohol, driving without insurance and driving otherwise than in accordance with a license.
Liz Miller, prosecuting, told Magistrates that Cairns had been stopped by Police in Pitts Lane, Binstead on 27th July this year.
Cairns vacated the driver’s seat of the black Nissan Qashqai – in which there were 3 child passengers aged between 3 and 6-years-old. It was at this point that officers noted that his eyes were glazed and he smelt of alcohol. He was breathalysed and subsequently arrested on suspicion of drink driving, alongside driving without insurance and driving without a license.
The defendant was later put on an evidential breathalyser at Newport Police Station and blew 68 microgrammes per 100ml of breath – well over the legal limit of 35.
James Cameron, defending, told the court that Cairns was in the process of fleeing an ‘incident’ and hadn’t wanted to drive but felt he had no other option. The defendant, who works as a painter and decorator, did admit that the circumstances surrounding the offences had fallen short of the ’emergency’ argument.
After deliberation, Magistrates told Cairns that his actions were very serious and had caused severe risk to the children in the vehicle.
Cairns was disqualified from driving for 18 months and offered the opportunity to undertake a driver awareness course. He was also fined £230 and ordered to pay £85 in costs and a £34 surcharge.

How did this low IQ escape a custodial sentence? Anything less is irrelevant as clearly he will offend again
